Terms and Conditions – Visionary Real Estate Media

These Terms and Conditions (“Terms”) govern your use of the services provided by Visionary Real Estate Media (“we,” “us,” or “our”), including real estate photography, videography, and related media services. By booking or using our services, you agree to these Terms in full.

1. Services Provided
Visionary Real Estate Media provides real estate photography, videography, drone imaging, and editing services for clients aged 18 and older, exclusively in California. Details of each service, including pricing and deliverables, are provided at the time of booking.

2. Client Responsibilities
Clients must:

  • Provide accurate property information and access for the shoot.

  • Ensure the property is safe and free of hazards for our team and equipment.

  • Obtain any necessary permissions for photography or drone use.

  • Ensure all client-provided materials, staging items, or keys are accurate and safe.

  • Clients acknowledge that failure to meet these responsibilities may delay or prevent services.

3. Payment Terms

  • Payment is due as outlined in your booking agreement.

  • Accepted payment methods: Stripe or PayPal.

  • Deposits may be required to confirm a booking.

  • Cancellation or rescheduling must be communicated in writing. Fees may apply.

  • Late payments may incur additional charges.

4. Deliverables & Ownership

  • Visionary Real Estate Media retains copyright for all photos and videos unless an explicit transfer is made in writing.

  • Clients receive usage rights for marketing, listing, and personal purposes as agreed.

  • We may use images/videos in our portfolio, website, or social media unless clients provide written restrictions prior to the shoot.

  • Delivery timelines and revision policies will be specified in the booking agreement.

5. Limitation of Liability

  • Services are provided “as-is.” We do not guarantee results, including property sales, leads, or marketing performance.

  • Visionary Real Estate Media is not liable for any damages, loss, or issues caused by third-party services (e.g., Stripe, PayPal, Wix, Google Analytics).

  • We are not responsible for lost opportunities due to weather, property conditions, or other circumstances beyond our control.

6. Force Majeure
We are not responsible for delays or failure to perform due to events outside our reasonable control, including but not limited to natural disasters, accidents, power outages, weather, or government regulations.

7. Indemnification
Clients agree to indemnify and hold harmless Visionary Real Estate Media, its owners, and employees from any claims, damages, or liabilities arising from:

  • Incorrect or misleading property information

  • Unauthorized use of materials or content provided by the client

  • Violations of local, state, or federal laws

8. Refunds and Revisions

  • Refunds are handled according to the terms in the booking agreement.

  • Minor edits or corrections are provided per the revision policy; substantial changes may incur additional fees.

9. Drone / Aerial Photography Disclaimer

  • Drone flights are conducted in compliance with FAA regulations.

  • Clients are responsible for ensuring the property is eligible for drone operations.

  • Visionary Real Estate Media is not responsible for restricted airspace, weather conditions, or client-provided flight information errors.

10. Governing Law
These Terms are governed by the laws of the State of California. Any disputes shall be resolved under California law.

11. Dispute Resolution

  • Clients agree to attempt mediation in good faith prior to any legal action.

  • Disputes not resolved through mediation may be pursued in California small claims court or through arbitration as agreed.

12. Changes to Terms
We may update these Terms from time to time. Any changes will be posted on our website at www.visionaryremedia.com. Continued use of our services constitutes acceptance of updated Terms.

13. Severability
If any part of these Terms is found unenforceable, the remaining provisions remain in full effect.

14. Entire Agreement
These Terms, together with any booking or service agreements, represent the entire understanding between Visionary Real Estate Media and the client.

15. Right to Refuse Service
Visionary Real Estate Media reserves the right to refuse service to any client at our sole discretion. Reasons may include, but are not limited to: unsafe property conditions, misrepresentation of property information, refusal to comply with these Terms, or any behavior that may endanger our staff, equipment, or other clients. In such cases, deposits or payments may be retained or refunded based on the circumstances and prior agreements.
